The Supreme Court ruled that granting retrospective Environmental Clearances (EC) for construction projects is illegal and goes against environmental principles.
It struck down the Centre’s 2017 notification and 2021 Office Memorandum (OM) that allowed ex post facto ECs, calling them arbitrary.
The Court emphasized that ECs must be obtained before starting a project, and such clearances should not be used to regularize illegal constructions.
However, ECs granted before the ruling will not be affected.
It criticized the government's actions for protecting illegal projects and undermining environmental laws.
