The Jammu and Kashmir High Court observed that "arguing that Jammu and Kashmir is illegally part of India and should separate from the Indian Union" falls under the purview of the Unlawful Activities (Prevention) Act - UAPA.
The court clarified that this is an offense under Section 13 of the UAPA.
Under this section, those who participate in, instigate, or advocate an "unlawful activity" can face imprisonment for up to seven years.
The High Court quashed a trial court's order that acquitted the accused under Section 13 and directed that charges be framed against them.
